Please read these terms carefully before using our service.
Agreement to Terms
Apex Scout ("the Service") is operated by João Paulo Cruz dos Santos, a sole proprietor established in Portugal ("we", "our", or "us"). By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.
Use of Service
Eligibility
You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you meet this age requirement.
Account Registration
To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Prohibited Uses
You agree not to:
- Use the Service for any illegal purpose or in violation of any laws
- Attempt to gain unauthorized access to any portion of the Service
- Interfere with or disrupt the Service or servers
- Transmit any viruses, malware, or harmful code
- Impersonate any person or entity
- Collect or harvest information about other users
Apex Scout aggregates track day event information from various sources. While we strive for accuracy, we do not guarantee the reliability of event listings. Users should verify details with organizers. Bookings and payments for events take place on the organizers' own websites and are solely the responsibility of the organizers; Apex Scout is not a party to those transactions.
By submitting content, you grant us a license to use it. You warrant that your content does not violate third-party rights.
AI-Generated Content
Apex Scout includes AI assistants that can suggest driving techniques, vehicle setups, maintenance actions, and event plans. These suggestions are generated automatically, may be inaccurate or incomplete, and are provided for general information only. They are not professional engineering, mechanical, safety, or medical advice. Motorsport and track driving are inherently dangerous. You are solely responsible for your vehicle, your driving, and your safety, and you should independently verify any AI suggestion, and consult a qualified professional where appropriate, before relying on it. Apex Scout is not liable for any loss, injury, or damage arising from your use of AI-generated content.
Payments & Refunds
Subscription Billing
Apex Scout offers paid subscription plans (Pro and Max) billed monthly or annually. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Prices are displayed in euros (EUR); any applicable taxes (such as VAT) are added on top and shown at checkout.
Free Trials
We may offer free trial periods for paid plans. Where a trial is started through checkout with a payment method on file, it automatically converts to a paid subscription at the end of the trial unless you cancel before it expires. Where a trial is granted without a payment method (for example, through a QR code or referral link), it simply ends and your account returns to the Free tier, with nothing charged. You may only use one free trial per subscription tier.
Refunds
Subscription payments are generally final and non-refundable. If you cancel, you keep access to paid features until the end of your current billing period, and no partial or prorated refund is issued for the remaining time. Limited exceptions apply: if we cannot honour a promotional offer you paid for (for example, a limited-spot promotion that sells out at the same moment you pay), we will automatically refund or cancel that charge; and if you upgrade mid-cycle you are charged only the prorated difference for the remainder of the period. If a payment is fully refunded, reversed, or successfully disputed (chargeback), the related paid access and any bonus benefits or points granted from that payment are removed.
Cancellation
You may cancel your subscription at any time through the billing section of your account settings, which opens our payment provider's secure portal. Cancellation takes effect at the end of your current billing period, after which your account reverts to the Free tier. Deleting your account instead cancels any active subscription immediately, with no remaining-period grace window and no refund for unused time.
Promotions
From time to time we run limited promotions, such as a discounted first year for early subscribers. Promotional offers are limited in number, available on a first-come basis, apply to one redemption per user, do not stack with other trials or offers, and may be withdrawn at any time. If a payment behind a promotional benefit is refunded, reversed, or successfully disputed, the promotional benefit and any bonus points granted with it are removed.
Intellectual Property
The Service and its original content, features, and functionality are owned by Apex Scout and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.
We have no control over and assume no responsibility for the content or practices of any third-party websites or services.
The Service is provided "AS IS" without warranties of any kind. We do not warrant that the Service will be uninterrupted or error-free.
Apex Scout shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the Service.
You agree to indemnify and hold harmless Apex Scout from any claims arising out of your use of the Service or violation of these Terms.
We may terminate or suspend your account access immediately, without prior notice, for any reason, including breaching these Terms.
These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions. This does not affect any mandatory consumer protections you enjoy under the laws of your country of residence.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the new Terms and updating the date below. Your continued use constitutes acceptance.
